Terms of Service

XBuddy is workplace software provided to employees and managers of an organisation that has subscribed with Digicore Software. Your account is issued by your company administrator. Use of the product is tied to your employment and/or the service agreement between your company and Digicore Software.

You must provide accurate information where you register or are invited. You are responsible for keeping login credentials (password, biometrics) confidential and for all activity under your account, including attendance recorded through that account (for XBuddy Work). Notify your company administrator or hello@xbuddy.co immediately if you detect unauthorised access.

Where your company buys XBuddy directly, plans are billed monthly or annually and renew automatically unless cancelled before the renewal date. Refunds may be available within 14 days of the initial purchase for annual plans. Module add-ons and token top-ups are non-refundable once consumed. Prices may change with 30 days' notice. If you use XBuddy solely as an employee of a subscribing company, billing is between that company and Digicore Software.

You agree to use the product only for lawful work within your company, and not to:

• Clock in or out for someone else, or spoof location or attendance data (XBuddy Work);
• Access, copy or disclose business data beyond your authorised scope;
• Attempt unauthorised access, distribute malware, or interfere with the product;
• Use the product to break applicable law or third-party rights;
• Copy, reverse-engineer or redistribute the software without permission;
• Resell or sublicense access without our written consent.

The software, interface, logos and content of XBuddy Office, XBuddy Work and the XBuddy platform are owned by Digicore Software or its licensors. Business data you enter belongs to your company. We do not claim intellectual property rights over that data and do not use it to train AI models without your company's consent.

Digicore Software grants you a personal, non-exclusive, non-transferable right to access the relevant product (XBuddy Office, XBuddy Work and/or the web platform) for work, only while you remain an authorised employee or member of the subscribing company.

Your access may be suspended or ended when you are no longer employed by the company; the company ends its service agreement with Digicore Software; or you breach these Terms. On termination, access through the apps and platform is revoked. Business data (including attendance records for XBuddy Work) remains owned and controlled by your company. After a company account is closed, data may be retained for 90 days to allow export before permanent deletion, except where law requires longer retention.

The product is provided "as is". To the extent permitted by law, Digicore Software is not liable for indirect, incidental or consequential damages arising from use of, or inability to use, the product. Our total liability for claims arising from these Terms or your use of the service shall not exceed the amounts your company paid in the 12 months preceding the claim.

We may update these Terms from time to time. Continued use after a change takes effect means you accept the new Terms.

These Terms are governed by the laws of Vietnam. Disputes will be resolved through binding arbitration in Ho Chi Minh City, Vietnam, unless both parties agree otherwise.
